What Does California Penal Code Section 653o Cover?

Section 653o restricts commercial import, possession with intent to sell, and sale of products made from a list of named animals.

The statutory text includes python, cobra, kangaroo, elephant, hippopotamus, zebra, and several lizard groups, among others. It also contains text covering alligator and crocodile, but federal courts have limited enforcement of those provisions for specific federally authorized species.

Can Python or Cobra Leather Be Sold or Shipped to California?

California’s statute expressly includes python and cobra in its commercial trade prohibition.

The crocodilian court judgments discussed below do not cover python or cobra. A seller should not treat a lawful sale in another state as proof that the same product may be shipped to a California customer.

Other snake species must be identified separately rather than assumed to fall under the word “python” or “cobra.”

What About Kangaroo, Elephant, Hippopotamus, Zebra, and Listed Lizards?

California’s statute also names kangaroo, elephant, hippopotamus, zebra, caiman, iguana, skink, and Teju, Ring, and Nile lizards.

The permanent caiman judgment creates a specific federal-law exception to enforcement for four named caiman species subject to 50 C.F.R. § 17.42. It does not create an exception for the listed lizards.

A 2025 federal district-court decision rejected a similar preemption claim involving Teju, Nile, and Ring lizard products. That decision reinforces why the exact species and court order must be checked rather than extending the crocodilian rulings by analogy.

Are Alligator and Crocodile Products Legal to Sell in California?

American alligator, Nile crocodile, saltwater crocodile and caiman products may be imported, and sold in California when federal law and 50 C.F.R. § 17.42 authorize the transaction.

In April in Paris v. Bonta, the federal court declared California Penal Code sections 653o and 653r unenforceable as applied to those three species within the scope of the federal regulation. The final judgment permanently enjoins California officials from enforcing the state provisions against those covered products.

Can Caiman Leather Be Sold in California?

Qualifying products from broad-snouted, brown, common, and Yacare caimans may be imported, possessed, and sold in California when federal law and 50 C.F.R. § 17.42 authorize the transaction.

In Los Altos Boots v. Bonta, the federal court entered a final judgment in 2024 declaring sections 653o and 653r unenforceable as applied to those four caiman species within the scope of federal authorization. The order permanently enjoins state enforcement for those covered products.

Does Owning Exotic Leather Differ From Selling or Commercially Importing It?

Yes. Section 653o is written around commercial import, possession with intent to sell, and sale, not a general ban on every act of private ownership.

That distinction does not answer every situation. Other state or federal laws may regulate possession, transport, endangered-species products, or items acquired unlawfully. Reselling an item can also create a different legal question from keeping it.

Do the Rules Apply Differently to Raw Hides and Finished Goods?

The California statute generally refers to a dead body, part, or product, so a finished good is not automatically outside the rule.

A wallet, boot, belt, watch strap, or bag can still be a product of the named animal.

What Should a Seller Confirm Before Shipping Exotic Leather to California?

Confirm the scientific name, product form, lawful origin, federal status, and whether a statute or court judgment covers the exact species.

  1. Use the supplier’s scientific name, not only a trade name.
  2. Check California Penal Code section 653o.
  3. For alligator, crocodile, or caiman, read the applicable final judgment and 50 C.F.R. § 17.42.
  4. Keep normal acquisition, species, tag, and transaction records that apply to the product.
  5. When eligibility is unclear, pause fulfillment and confirm the current rule before shipping.

Does a Successful Online Checkout Prove an Exotic Leather Order Can Ship to California?

No, it does not establish legal eligibility for the exact species and product.

Sellers should review California law, applicable court orders, federal requirements, species records, and the destination before fulfillment. This is general information, not legal advice.

Should California Eligibility Be Checked Using Only a Common Species Name?

No, common names can be broad or inconsistent, so California eligibility should be checked using the scientific species name, product form, and current law.

Court orders, federal requirements, and seller policies may also affect a transaction, which is why a one-word product label is not enough.
